Ex-Dir ISM issues illegal transfer orders, then wastes public money on caveats

JAMMU, May 14: A former Director of J&K Indian Systems of Medicine (ISM) reportedly wasted Rs 58,000 from the exchequer as charges for filing 29 caveats, most of which were against the transfer orders issued by him only.
The documents available with Early Times clearly indicate that open loot has been facilitated allegedly by former Secretary (Technical) Health & Medical Education who is also holding additional charge of Director ISM.
Dr Abdul Kabir Dar, the then Director ISM, had issued transfer orders in absolute violation of transfer policy, and later he filed caveats through Advocate General office in High Court at the cost of state exchequer.
Two months ago, Dar had issued transfer orders in favour of scores of doctors vide order (No. DISM/ Est/13244-52, dated 16-03-2018 and DISM/Est/13306-14, dated 19-03-2018) allegedly in lieu of monitory gains. These orders were issued on the dates when he was actually at Delhi in connection with some official work.
Dar was transferred by virtue of an order issued in a cabinet meeting held on 20-03-2018. New Director ISM Niraj Kumar, who was out of station, didn't assume charge for a couple of days, and Dar got opportunity to issue scores of illegal transfer orders in brazen violation of the transfer policy.
Apprehensive of fraudulent nature of the transfers ordered by him, Dar himself filed caveat in the High Court.
Additional Advocate General for Health and Medical Education department forwarded a letter to Director ISM vide No. MID/AAG/17/506, dated 26-03-2018 charging Rs 58000 as incidental charges for filling 29 caveats.
Taking cognizance of misuse of position by Dar, the MoS for Health Aseya Naqash directed Principal Secretary Health to put all these illegal transfer orders in abeyance with immediate effect.
Notably, this practice of issuing fraudulent orders and instantly filing unnecessary caveats by Dar was in vogue for last couple of years, putting the exchequer to loss.
Caveats have never been filed in support of transfer orders issued by administrative department, but they have been always filed in respect of transfer orders issued by then ISM Director. It indicates the malafide nature of issuing transfer orders followed by instant caveats by the Director himself.
