Dispute over diverting of water

Jammu, July 1: In a dispute over the diversion of water between village Baasti (Mari) Tehsil & District Reasi and Madhuri-Bhadra a petition was filed by inhabitants of Village Marhi seeking direction to order dated 26.6.2018 passed by the respondent no. 4 where under direction to Teshildar and SSP Reasi for Magisterial Police assistance to carry out restoration/execution of lying water scheme at Mari Village being totally illegal, arbitrary and contrary to the legal and factual position and passed order without giving any opportunity of hearing to the petitioners and also seeking direction to Executive Engineer PHE Reasi Division not to divert or change the existing water supply having been provided to the village Baasti (Mari) Tehsil & District Reasi by succumbing to influence being yielded by residents of Habitation Madhuri-Bhadra which is one of the habitations of Village Mari, to the detriment of the various other habitation of village Baasti (Mari).
Justice Janak Raj Kotwal of J&K High Court Jammu Wing after hearing Sr. Adv Sunil Sethi with Adv Sumit Nayyar for the petitioner issued notice to the respondents and ordered that subject to objections and till next dale before the Bench, the approved plan of the Water Scheme (WSS Mohra Basil) shall not be deviated from and the impugned communication No. PS/DC7DU/ 74/739-4I dated 26.06.2018 shall stay.
