Bail denied to accused in murder case

Jammu, Jan 24: Principal Sessions Judge Rajouri Shahzad Azeem rejected bail of Rukhsana Kouser and Yasmeen Akhter facing trial in, FIR No.362/2017, U/S, 302/201/109, RPC.
According to the police case that deceased, Shamshad Begum was married to Jabbar Hussain on, 14.04.2017, but on noticing that Jabbar Hussain had developed illicit relations with his sister-in-law Rukhsana Kouser, marital relations between deceased and Jabbar Hussain, ran into rough weather and also Jabbar Hussain adopted hostile attitude towards the deceased. It is important to note that Yasmeen Akhter is daughter of Munshi Khan and the niece of Jabbar Hussain, whileas, deceased, Shamshad Begum was daughter of Razia Begum, and sister of Nazia Kouser. Both are sister and niece of Munshi Khan, the father of Yasmeen Akhter, respectively. Therefore, it emerges that deceased/complainant and accused party are close relatives. It is further seen that as per prosecution story Jabbar Hussain has much liking and inclination towards Rukhsana Kouser, which caused annoyance to deceased, Shahshad Begum, therefore, all the accused persons hatched a conspiracy to get rid of her. Accordingly, in a pre planned manner, during the intervening night of 12/13 of August, 2017, all the accused persons in pursuance of well thought plot, strangulated Shamshad Begum to death.
Court after hearing both the sides observed that application is hit by the bar of Section, 497 Cr.P.C, in granting the bail to applicants, who alleged to have committed offence carrying punishment for death or imprisonment for life. Therefore, application was dismissed.
