SIC directs to provide info under RTI
Selection of Civil Judge / Munsiff by PSC

Jammu, Jan 24: State Information Commission (SIC) has directed J&K Public Service Commission (PSC) to provide information about marks obtained by selected candidates (open merit quota) in the written exam /viva conducted for the post of Civil Judge / Munsiff last year. The information was not provided by the Public Information Officer (PIO) under RTI.
Details available with Early Times reveal that on 01.06.2018 an RTI application was filed by one Arihant Gupta with the PIO, J&K Public Service Commission (PSC). On the failure of the PIO to respond to the RTI request of the appellant within a specified period, the appellant filed 2nd appeal before the State Information Commission (SIC) on 29.08.2018 submitting therein that not only the PIO has failed to provide him the information, the FAA has also failed to decide the first appeal. The appellant accordingly prayed that directions should be issued to the respondents to furnish the requisite information to the appellant as requested by him through his RTI request dated 01.06.2018.
The PIO submitted that since the selection process had been completed now, the information would be provided to the appellant. Hearing was adjourned by SIC with the direction to the PIO, J&K PSC to furnish the information to the appellant within 10 days from the date of receipt of the order dated 08.11.2018.
The appeal again came up for hearing before SIC on 24.12.2018. The appellant submitted that the PIO, J&K PSC has not provided any information to him inspite of the fact that the selection process for the post under reference has since been completed.
SIC in its order ruled that denial of information to an information seeker makes the PIO liable for penalties under the Jammu and Kashmir Right to Information Act, 2009. The present appeal is disposed of with a direction to the PIO to furnish the complete information as sought by the appellant through his RTI request dated 01.06.2018 within a period of two weeks from the date of receipt of this order.
