Court reject bail of 'notorious' thief

Jammu, Nov 2: CJM Samba Ajay Gupta rejected the bail application of Akhter Ali a notorious thief allegedly involved in various theft case. CJM Samba Ajay Gupta after hearing APP Anil Saini for the State whereas Adv Deepak Gupta for the applicant observed that it has been prima facie establish by the prosecution that the accused is a involved in so many cases of theft which have been conducted in the current year itself and the thefts have been done of the same material i.e. the Iron. The said fact is sufficient to establish that prima facie case against the applicant/accused to establishes that the nature of thefts done in the current year and the material stolen in all those thefts are same for which various FIRs have been registered in the District Samba itself. Court further observed that As the accused is involved in so many cases and the investigation are yet to be complete, the recoveries are yet to be made and prima facie involvement of the accused in the above mentioned cases have been made out. It has also been observed that the recoveries in many cases are yet to be made and other co-accused of the gang of thieves run by the accused who is the kingpin the gang are yet to be arrested. Furthermore there is every apprehension that the accused will tamper the evidence and will jump over the bail and will not be arrested again. Thus, if in such type of offences the accused is granted bail, it will certainly affect the larger interest of public and the State. The general public will lose its faith in criminal justice system. With these observations Court rejected the bail application. (JNF)
