Court stays criminal proceedings against SHO Kishtwar

Kishtwar, Oct 6: Session’s Court has stayed the criminal proceedings against Aejaz Ahmad Wani, Station House Officer Kishtwar.
After hearing the counsel of the petitioner (SHO Kishtwar) in a criminal revision petition filed by Wani through his counsel advocate Shaik Saroori in terms of Section 397 CrPC the Session Judge Kishtwar stayed the proceedings. Judicial Magistrate 1st Class (Munsiff) Kishtwar had passed the interim order on 30.09.2020 in a complaint titled Joginder Bhandari V/s Aejaz Ahmad Wani (SHO P/S Kishtwar).
As per the details available with “Early Times”, the Counsel of the petitioner stated that the petitioner is serving in a highly disciplined J& K Police force and have been performing his duties with utmost sincerity, dedication, honestly and in a lawful manner from the last 20 years and has been awarded commendable certificate by Inspector General Of Police J&K & Director General Of Police Jammu as well and the petitioner is always submitted himself to the supremacy of law of land and cannot even remotely think of acting contrary to the norms of their duties and against the provisions of law.
He stated that the respondent has filed a false, frivolous and concocted complaint titled Joginder Bhandari V/s Aejaz Ahmad Wani before the Hon’ble Court of Munsiff (Judicial Magistrate Ist. Class) Kishtwar with ulterior motive to malign the petitioner and the J&K Police.
He added that vide impugned order dated 30.09.2020 passed in the complaint mentioned supra, the Hon’ble Court of Munsiff Kishtwar has taken cognizance against petitioners U/Sec 220, 342 IPC and the matter has been listed for 23.10.2020 for presence of the petitioner.
The counsel further stated that the impugned order is against the provisions of law and as such is liable to be set aside. After hearing the counsel of the petitioner, District Principal and Session Judge Kishtwar S L Lalhal issued the stay on the order passed by Munsiff Court Kishtwar.
“In view of the averments made in the revision petition and oral submissions made by the Ld. Counsel for the petitioner, operation of the order dated 30-09-2020 passed by the Ld JMIC (Munsiff) Kishtwar in the complaint titled Joginder Bhandari V/s Aejaz Ahmad Wani (SHO P/S Kishtwar) is stayed till the disposal of revision petition” read the order, the copy of which is available with Early Times.
