DB issues notice to Law Secretary & others in petition seeking benefit of promotion/release of Super Time Scale

JAMMU, Feb 18: In a petition filed by Satinder Singh, Additional Registrar in J&K High Court seeking direction to the respondents to frame a scheme by issuing a notification in pursuance to the various judgments passed by this High Court and upheld by the Apex Court, on the subject matter regarding grant of benefit of similar grades/pay scales automatically on the same terms as is being granted to the counter parts of the petitioner's cadre working in the Civil Secretariat seeking direction to respondents to grant and accord the benefit of promotion/release of Super Time Scale of Rs. 37400-67000/-(un-revised) with pay Grade of Rs.10,000/-, in favour of the petitioner's cadre in the Hon'ble High Court, and resultant release of the said benefit in favour of the petitioner, who is senior-most in the Hon'ble High Court establishment in all the cadres, in line with the provisions of SRO 386 of 2008 and SRO 197 of 2018, w.e.f the date, the provisions of SRO 386 of 2008 were directed to be amended in terms of SRO 197 of 2018, dated 25.4.2018.
A division bench of Jammu & Kashmir and Ladakh High Court comprising Justice Sanjeev Kumar and Justice Mohan Lal after hearing petitioner in person, issued notice to Law Secretary and Registrar General J&K High Court returnable within four weeks. During the course of hearing, petitioner also sought directions to Registrar General to incorporate the different Cadre posts along with the pay scales in the Jammu and Kashmir High Court Staff (Conditions of Service) Rules, 1968, and amend the Schedule accordingly, appended to the aforementioned Rules and to release the benefits commensurate with their status, in favour of the officers on the rolls of High Court Establishment, as are being provided to their counter-parts working in the Civil Secretariat, holding the same pay grades/scales, with a further command in this regard to incorporate the same in the aforementioned rules or the schedule appended to the said Rules or by way of issuing a notification in this regard making it a part of rules aforementioned.
