HC directs GAD Secy to file ATR in Div Com's report against ex-Dy CM's PRO

Jammu, Aug 4: High court judge Tashi Rabstan today directed GAD secretary file Action Taken Report (ATR) before the next date of hearing with regard to October 1, 2014 communication No 101/Misc-J/1604-06 whereby then divisional commissioner, Jammu, Shantmanu had recommended strict action against forest guard-turned-additional PRO Kewal Krishan Sharma of ex-deputy CM Tara Chand.
In the communication, Shantmanu had informed GAD that a report was published in newspapers as regards the distribution of relief to the flood affected people of Palatan panchayat by SDM, Khour, through Kewal.
Taking cognizance of the matter, then Deputy Commissioner, Jammu, was directed vide No 101/Misc.-J/1571-72 of September 28, 2014 to issue show cause notice to the SDM for violation of Service Conduct Rules by promoting a political party/leader. The DC vide letter No DMJ/PA/ 2014/160-63 of September 29, 2014 reported that the basic mischief was done by the PRO who came to the place of distribution of relief with his PSOs and intentionally hijacked the relief distribution function with the help of his PSOs and got a few photographs clicked and sent them for publication in a newspaper.
He reported that there were discrete reports about the harassment and misuse of official position by Kewal especially in the offices of CEO, Jammu, Director School Education, Jammu, and recommended that his activities be got probed and consequent action as required under law be initiated.
When the PIL came up for hearing, the petitioner in person alleged that Kewal was being shielded by GAD as despite recommendation of action against him by then Divisional Commissioner way back in October 2014, till date no action had been taken against him.
Upon this, Justice Rabstan took serious view of the matter and directed GAD Secretary ATR before the next date of hearing with regard to communication No 101/Misc-J/1604-06 of October 1, 2014.
He observed that the status report filed by Mukesh Singh (IPS) Inspector General of Police (Personnel) PHQ revealed that PSOs and guard provided to Kewal stands withdrawn and to that extent the grievance of the petitioner has been redressed.
The petitioner also drew the court attention to the April 27, 2015 order whereby the court had deferred the impleadment of then SSPs -- Atul Goel and Anand Jain. He submitted that this consideration had been deferred till the filing of the version by Kewal who had sought time to disclose his stand. He said that the reply now stands filed by Kewal through his counsel and today both the former SSPs be arrayed as party respondents as they provided undue security cover on political considerations to the additional PRO and they be asked to explain their conduct.
After hearing him, Justice Rabstan directed that the question of the impleadment of Atul Goel and Anand Jain would be considered on the next date of hearing. (JNF)
