As moratorium ends, DB seeks action taken report against illegal buildings

Srinagar, Feb 1 : A division bench of High Court today asked Srinagar Municipal Corporation about the steps taken by it against illegal constructions as moratorium on sealing of such constructions has already expired on December 31, 2015.
In 2014, then NC-congress government enacted J&K Civic Laws (Special Provisions) Act, 2014 so that a comprehensive policy could be formulated to tackle the issue of these violations by the end of March 2015. Later it was extended by December 2015.
"The moratorium has expired, what steps have you taken," a division bench of the court comprising Justice M H Attar and Justice D S Thakur asked counsel for SMC. The latter sought time and subsequently the court asked him to file the status report.
The court was hearing a Public Interest Litigation filed by advocate Mujeeb Andrabi, seeking among other directions to clear Srinagar city of illegal constructions.
The court also ordered its registry to club the petition with another PIL Kashmir Consumer Welfare Forum and others VS Commissioner Transport J&K Srinagar which is already posted for a hearing on February 8.
The legislation, providing moratorium on sealing of illegal constructions till December 2015 was passed in both Houses of the legislature during NC-Congress government.
The Government then constituted a high power committee of experts to go into the issue of illegal constructions and suggest remedial measures.
In the draft policy, the panel had reported recommended only those illegal constructions that have come up before March 5, 2014 will be considered for one time settlement by way of imposing hefty penalty while as no unauthorized construction having come up after March 5, 2014 will be regularized. In case of major violations having taken place before March 5, 2014 no leniency has been proposed in the policy.
The exercise to formulate policy was started on the directions of the High Court, which had also issued directions for sealing of illegal/unauthorized constructions.
