Six murder accused acquitted getting benefit of doubt

Jammu, Dec 6 (JNF) : Principal Sessions Judge Samba Kartar Singh has acquitted Subash Singh s/o Krishan Singh, Rajesh Singh s/o Jagdish Singh, Vijay Singh s/o Krishan Singh, Ranjit Singh s/o Jagdev Singh, Rakesh Singh s/o Jagdish Singh and Ikram Singh s/o Netar Singh from the murder case by giving benefit of doubt. After hearing Special Public Prosecutor SS Sambyal appearing for the state whereas Adv Rajesh Kotwal with Adv Arvind Gupta appeared for the accused persons, Principal Sessions Judge observed that The prosecution witnessed have narrated different story during the investigation while in the court a new story has been introduced by them. There were no eye witnesses of the alleged occurrence as per the FIR registered at the instance of the wife of the deceased but from where the five eye witnesses nawely: Shrista Devi,Santosh Kumari, Shakti Devi,Raksha Devi and Kamlesh Devi have been introduced at the later stage of the investigation, has not been explained either by the witnesses or by the investigating officer. That fair investigation is the constitutional right of the accused but since from the facts and circumstances of the case, the investigation is totally biased and tainted and held that prosecution has led two sets of evidence, one which favours the accused and other which favours the prosecution. In other words, the prosecution has put forth two parrell stories regarding the alleged occurrence and as such, it has become difficult for the court to separate the grain from the chaff and which story is to be believed. The law is settled that in such a situation benefit of doubt always goes to the accused. They are, therefore, given the benefit of doubt and acquitted of the charges framed against them.
