ULB Director Laharwal in trouble, govt aware but silent
Adda/Entry Fee contract for MC Budgam

JAMMU, Dec 6: Director Urban Local Bodies Kashmir S.A.Laharwal is in soup over allotment of Adda contract to a contractor who had not participated in bidding process.
Adda contract of Municipal Committee Budgam for the year 2012-13 was approved by Director Local Bodies S.A.Laharwal vide letter no: DULB/g/598/2345 dated 19-05-2012 in favour of one Ali Mohammed Sheikh son of Ghulam Rasool Sheikh for Rs. 18.39 Lakh. This approval was granted in complete violation of an earlier order issued by Laharwal asking the executive officer of Municipal Committee Budgam not to accept the contract bid below Rs. 35 lakh.
Laharwal had vide letter no: DULB/G/598/6766-67 dated 22-03-2012 asked Executive Officer Municipal Committee Budgam to conduct the auction of add/entry fee for the year 2012-13 afresh. In case of poor response to the re-auction proceedings, Laharwal had asked the EO to collect the Adda entry fee departmentally.
He had put a rider alongwith this line asking EO that maximum realization of the Adda entry free contract shall not in any case be less than Rs. 35 lakh. Laharwal sent this communication to EO after the later vide letter no: MC/Bud/2012/1499 dated 10-03-2012 had intimated him about the four bidders who had come forward to offer rates for the Adda contract fee auction for the year 2012-13.
These four bidders namely Hafizullah Bhat, Mohammed Amin Hajam, Naseer Ahmed Sheikh and Towfiq Ahmed Bhat had offered Rs. 35 lakh, Rs. 26 Lakh, Rs. 25 Lakh and Rs. 15 lakh 85 thousand respectively. However, EO in his letter intimated Laharwal that first bidder was hesitating to deposit the money despite a notice having been served to him formally vide EO's office no: MC/Bud/1415-25 dated 01-03-2012.
EO had asked Laharwal to authorize him to call the second lowest bidder namely Mohammed Amin Hajam whose Bid at Rs. 26 lakh was 70 percent above the last year ceiling. However, this proposal was shot down by the Director, who asked the EO not to take any Bid below Rs. 35 lakh in any case. But, as mentioned above, Laharwal later gave away the contract to a person who had not participated in the bidding.
Ali Mohammed Sheikh managed the contract at Rs. 18.39 lakh. Sources said that state government has received several complaints in this regard but preferred to maintain criminal silence. "Chief Minister's grievance cell has also been intimated about the alleged wrong doings of Laharwal. There are apprehensions that codal formalities have violated for some reason," said an official.
