| Court acquits Lab Assistant as prosecution fails | | Misappropriation of over ` One lakh | | Early Times Report
Jammu, Dec 15 (JNF): Principal Sessions Judge Ramban MA Choudhary has acquitted Zakir Hussain S/o Ghulam Mohd R/o Nagam Verinag Tehsil and District Anantnag from the charges of misappropriation of more than Rs one lakh, as prosecution failed to prove its case. According to the police case , a written complaint moved by Principal Govt. Higher Secondary School Ramban vide his No. DO/HRbn/5-7 dated 23.11.1998 alleging therein that Zakir Hussain did not produce the cash books as directed and on 27.10.1998 when the orders were issued to produce the cash books, Zakir Hussain who was incharge of five local funds presented Cash books wherein it was found that the entries in Pass Books and cash books did not tally with the Bank Ledgers which established that Zakir Hussain had made fraud entries in Pass Books and cash books in his possession. In these circumstances a breach of trust and fake and fraudulent entries in the record had been committed and embezzlement of more than Rs one lakh had been made in the cash, Ramban Police registered a case vide FIR No. 16/1998 under section 409/466/467/468 RPC. After completion of investigation, police presented challan in the Court of law. Principal Sessions Judge Ramban MA Choudhary after hearing both the sides observed that the prosecution has failed to bring home the charge against the accused for want of cogent, credible and trustworthy evidence to record conviction of the accused. The prosecution case fails and is dismissed. Accused is acquitted of the charge. |
