| Floriculture Deptt to file status report with cost | | PIL regarding encroachment of forest land | | Early Times Report
Jammu, Dec 21 (JNF): Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Hasnain Massodi in a Public Interest Litigation directed Floriculture Deptt which look after largest number of parks, to file status report with regard to each one of the parks and measures taken to the develop the same so as to create proper lung area for the residents of Jammu. On the last date of hearing last opportunity was granted to Floriculture deptt to file status report, despite granting last opportunity the status report has not been filed and request has been made for further times. Division Bench directed that status report be filed a week before adjourned the date with a advance copy to the counsel for the petitioner, however, same shall be subject to the payment of Rs 5000/- as costs. The costs be deposited with the legal service authority. Division Bench after hearing Adv Ajay Abrol for the PIL whereas Neeru Goswami Deputy AG for the state and Adv SS Nanda for the JMC, observed that status report was also required to be filed with regard to the steps taken in pursuance to directions dated July 31, 2012 to develop forests on both sides of Tawi river in order to save the forest land for encroachment. No status report has been filed by the respondents despite granted last opportunity. Division Bench ordered that status report be now filed which shall be payment of Rs 3000/- as cost same be deposited with the legal service authority and fixed second week of February, 2013 for hearing. This direction has been passed in a Public Interest Litigation filed by Jammu Consumer Council seeking direction to the state functionaries to stop any kind of encroachment of forest land in Ramnagar Wild Life Sanctuary or any other area. |
