| 15 yrs RI, Rs 1 lakh fine awarded to accused involved in NDPS & Arms Act | | | Jammu, Dec 28 (JNF): Principal Sessions Judge Kathua MK Hanjura today awarded 15 years rigorous imprisonment and fine Rs 1 lakh to one Harpaul Singh @ Balochi s/o Puran Singh of W- 14 Kathua booked under NDPS and Arms Act. After hearing Adv KB Mahajan for the accused whereas Public Prosecutor Ravi Kumar for the state, the Principal Sessions Judge Kathua MK Hanjura observed that the instant case from the above perspective the consequences of the narcotics on the human health and disastrous. These can cause even death. Court observed that the use of narcotics cause incalculable harm to body and mind of youth who get addicted to it and thus enhances the harmfulness of the offence. Keeping in view the gravity of issue court awarded 10 yrs RI and fine Rs 1 lakh u/s 22 NDPS Act and five years RI and fine Rs 5000 u/s 25 Arms Act. Court further clarified that both the sentences shall run concurrently. According to the police case that on June 8, 2007, police conducted search of house of accused and recovered a gun (315 bore) along with 26 live and two empty cartridges, 12 Bore Gun along with 14 live and 11 empty cartridges, one pistol along with 7 live and 6 empty cartridges from the house of the accused besides poppy straw weighing 261 KG. After completion of investigation challan was presented in the court. |
