| Court denies bail to impersonator | | | early times report Jammu, Jan 12 (JNF): CJM Jammu SR Gandhi rejected the bail application of one Rajinder Singh S/o Revail Singh R/o RS Pura who impersonated himself in the Court of Sub-registrar for power of attorney of land. Accor-ding to the police case that Police has registered a case u/s 419/467/468/471 RPC and allegations against the accused are that the accused in connivance with other accused persons forged the power of attorney to the land of the complainant and also appeared as impersonator before the Sub-Registrar and on this basis of power of attorney alienated the land of complainant to one Ramneek Singh. CJM Jammu SR Gandhi after hearing CPO Harminder Singh with PO Rajeshwar Basotra observed that the fact of circumstances of each case will govern the exercise of discretion in the matter of grant of bail. Among other considerations, which a court has to take into account in deciding whether bail should be granted in a non-bailable offence, is the nature of the offence and if the offence is of a kind in which bail should not be granted considering its seriousness, the bail should be refused. The investigation of the case is at the initial stage and in case accused is released on bail at this stage of case there is every-likelihood of accused influencing the witnesses and absconding resultantly hampering the witnesses. |
