| Court upholds sentence awarded by trial court in accident case | | | early times report Jammu, Feb 1 (JNF): Ad-ditional Sessions Judge Udhampur has dismissed an appeal filed by one Ram Saran driver of a truck who was convicted and sentenced by Judicial Magistrate Majalta and sentenced him to undergo imprisonment for a period two years and fine Rs 5000 u/s 304-A RPC. The case of prosecution is that on April 17, 2009 the accused drove truck bearing No. PB10X/0499 rashly, negligently and at high speed on Dhar Road towards Punjab and on reaching village Dhema at about 4.10 P.M lost control over the vehicle and crushed one minor boy, namely Mohammad Azhar to death who was standing on the roadside with his mother. After completion of the investigation a charge sheet for the commission of offences u/s 279/304-A RPC was filed in the court. The court after hearing both the sides and gone through the judgment and heard the counsels in length, observed that the appeal therefore merits dismissal and is dismissed accordingly. The judgment of the trial court is upheld. The sentence imposed by the trial court was suspended after the filing of the instant appeal. Since the appeal has failed so the suspension of sentence against the appellant is revoked and the appellant is taken into custody and shall be sent to District Jail Udhampur to suffer the sentence as ordered by the trial court. The bail furnished by the appellant for his release after conviction is cancelled. |
