Army not in favour of amendment to AFSPA

Jammu, Feb 2 : Top Army functionaries, stationed in Jammu and Kashmir, continue to oppose even amendment to the AFSPA on the plea that any attempt at diluting the original spirit of the Act could adversely affect counter infiltration and counter militancy operations in the state. These functionaries have revealed that marked decline in the incidents of militancy related violence in Jammu and Kashmir is the result of effective counter insurgency grid having been in operation in the state. A senior Army officer said that in the context of these positive developments it would be almost suicidal if the AFSPA was either lifted from the state or amended. Referring to the demand for amending the AFSPA so that troops were not able to commit rape of women senior Army functionaries said that even under the traditions, practices and laws in force in the Army no jawan enjoyed immunity for rape. They said that judged by the history of insurgency troops have been maligned by those adept in circulating false and malicious propaganda. During the last over a decade as many as 90 per cent complaints of human rights violations against the Army have been found baseless. Referring to human rights violations a senior Army officer said that out of 995 cases only 25 complaints were found true. And 59 Army personnel found guilty on charge of having indulged in human rights violations were punished.
He said "we want fast trials and punishment and that can be possible when human rights violation cases were tried in the military courts," adding that if the AFSPA was amended and cases against Army men were tried in the civil courts the trial would continue for years. He said that the Army authorities have conveyed to the Government of India that there was no need for amending the AFSPA because the military courts had set up a good example of awarding speedy punishment to any Army man who was found guilty of indulging in human rights violations.
