| Father gets life- imprisonment for raping minor daughter | | |
Jammu, Feb 2 (JNF): In a rarest of the rare case where a father reduced himself to an animal raped her minor daughter, Principal Sessions Judge Udhampur AK Koul today awarded rigorous life-imprisonment and fine Rs 10,000 to one Yog Raj of Ramnagar who committed rape upon his minor daughter. Principal Sessions Judge Udhampur AK Koul after hearing Public Prosecutor Navneet Gupta for the state observed that crimes against woman are rapidly increasing and unless a message is send down that the culprits would not be spared, it would go on increasing. The reason being that the penal law has been rendered emasculated either due to procedural technicalities or lack of investigation skills or our over solicitous attitude towards the culprits.
"The accused in this case has demonstrated animal tendencies and has not even spared his daughter, court observed and added, "justice demands that courts should impose punishment befitting the crime so that the courts reflect public abhorrence of the crime and thus court does not find any mitigating circumstance in this case which could entitle the accused to some leniency. Observing this court awarded rigorous imprisonment for life and also to a fine of Rs.10,000/- to Yog Raj S/O Krishan Lal of Dheeran, Tehsil Ramnagar and further said that case file shall be submitted to High Court through Registrar Judicial Jammu and the sentence imposed on accused shall remain in abeyance till it is confirmed by the High Court.
According to the police case a complaint on July 25, 2012 was lodged by mother of the prosecutrix at Police Station Ramnagar, alleging therein that on previous day she had gone to her parental home and on July 25, 2012 at about 10.30 am her 13 year old daughter (prosecutrix) came to her (informant's) parental home and complained that at about 9 a.m she was alone in her home when accused took her to a nearby field and raped her forcibly. On the basis of this report case FIR was registered u/s 376 RPC. During investigation the prosecutrix was got medically examined in Ramnagar Hospital. Her statement was got recorded u/s 164-A Cr.PC whereafter accused was arrested The investigation culminated in this charge sheet after the investigating officer was satisfied that accused had committed offence u/s 376 RPC. |
