JAMMU. Feb 21:Taking strong notice of publication of advertisements regarding overseas jobs by unauthorized foreign employees/recruiting agents, the Press Council of India (PCI) has issued Model guidelines for publishing overseas advertisements in accordance with Emigration Act 1983.
These fresh guidelines will regulate the manner and procedure to be followed by the companies for advertising the overseas vacancies in newspapers besides saving the innocent Indian Workers seeking jobs abroad from being duped by unregistered recruiting agents or any other unscrupulous element. As per the guidelines, the advertisements should, inter-alia, contain registration certificate number, permit number, full address with telephone number, post box number, e-mail address (these could be given in addition to the full address but not as the mode of communication), name of the employer, his central registration number, telephone number, e-mail ID etc. alongwith the name of destination country, no fee towards processing application or for any other purpose shall be charged from the applicant, name of the posts/jobs, number of position/vacancies in each category and the salary offered to each category of job.
Other model guidelines included no employer can recruit any citizen of India for employment in any country or place outside India except (a) through a recruiting agent competent under the Act to make such recruitment or (b) in accordance with a valid permit issued in this behalf as per the provisions of Section 16 of the Emigration Act 1983, no recruiting agent shall commence or carry on the business of recruitment of Indian citizens for overseas employment except under and in accordance with the certificate issued by the registering authority i.e. Protector General of Emigrants in the Ministry of Overseas Indian Affairs as per section 10 of the Act, a foreign employer or a project exporter can recruit Indian citizens for employment abroad only after obtaining permit from the Indian Mission in the country of employment or the Ministry of Overseas Indian Affairs, New Delhi, it is mandatory for the registered recruiting agents, foreign Employers and Project Exporters to display their registration certificate number while inserting advertisement for recruitment, a copy of the registration certificate in case of recruiting agents and permit letter in case of foreign employers and project exporters may be asked to be attached with the advertisement form as proof of their being genuine persons. In case of any doubt, the publisher can ask for copies of demand letter and power of attorney supposed to have been given by the foreign employer or sponsor to an agent, on the basis of which the said advertisement is being released. Besides, clarifications may be sought from the Protector |General of Emigrants, New Delhi or from the eight offices of the Protector of Emigrants located at Delhi, Mumbai, Chennai, Kolkata, Thiruvananthapuram, Cochin, Chandigarh and Hyderabad.
