Jammu, Mar 9: A Division Bench of Jammu & Kashmir High Court Jammu Wing comprising Chief Justice MM Kumar and Justice Mansoor Ahmed Mir has dismissed LPA filed by Power Grid Corporation of India Ltd against the judgment passed by Writ Court on February 15, 2011 regarding compassionate appointment and imposed costs Rs 10,000 on Power Grid Corp. Ltd payable to the petitioner. According to the petitioners case, his father Bodh Raj an employee of the Power Grid Corporation Ltd passed away on 01.04.2003 at his residential quarter at Power Grid Colony, Kishanpur. Petitioner- Rahul Dogra applied before the Corporation for his appointment on compassionate grounds. However, his case was rejected on the ground that the death of his father was not as a result of accident on duty. This landmark judgment written by Justice Mansoor Ahmed Mir for the Division Bench after hearing both the sides, observed that on their own showing, the appellants-writ respondents have rejected the claim of writ petitioner mechanically and without any justification/Reason. It appears the appellants-writ respondents, have made the petitioner to run from pillar to post without any ground while denying him appointment on compassionate grounds. Accordingly, the appeal is dismissed along with all connected CMAs with costs of rupees ten thousand payable to the petitioner by the appellants-writ respondents within a period of two months. |
