SIC puts CEO Rajouri on notice for non compliance
Alleged victimization of retired ZEO

JAMMU, Mar 9: The State Information Commission while taking a strong note of non compliance of orders issued by the State Information Commissioner Dr SK Sharma has issued a show cause notice to Chief Education Officer Rajouri in which commission has sought his explanation why penalty could not be imposed on him for violating the orders of the commission.
As per details available with ET Plus the State Information Commission vide decision No SIC/J/A/193/2012/394 dated 26-11-2012 had directed the Chief Education Officer, Rajouri who is also the Public Information Officer under JK RTI Act (PIO) to provide information pertaining to cash in lieu of leave in the revised pay scale of Dharam Paul Sharma, who is a retired Zonal Education Officer (ZEO) Manjakote within 2 weeks from the date of pronouncement of this order under an intimation to the Commission. The complainant Dharam Paul Sharma rtd ZEO filed an application dated 26-12-2012 before the Commission wherein he alleged that CEO did not implement the SIC's orders .
The complainant informed the State Information Commission that his service book was available in the office of CEO, Rajouri and he has to provide the information relating to cash in lieu of leave in revised pay scale. However, ZEO, Manjakote vide letter No ZEO/MK/564-65 dated 08-12-2012 informed the Commission that service book of information seeker was not available in his office and hence no process can be initiated in this regard which is only the cause for non drawal of his claim applied through RTI Act. Commission summoned CEO Rajouri who is also the PIO vide its notice No SIC/J/A/193/2012/641-42 dated 6-02-2013 to appear before the Commission on 14-02-2013 on (12.00 a.m) at Jammu's office. Despite a valid notice from the Commission, CEO Rajouri failed to cause his appearance before the Commission.
"He is hereby directed to show cause why fine u/s 15 read with Code of Civil Procedure Samvat, 1977 shall not be imposed upon him for non-compliance of the notice to appear before the Commission within two weeks from the date of pronouncement of this order. In view of letter of ZEO Manjakote, CEO Rajouri/PIO who is in possession of service book of information seeker is hereby directed to comply with the direction issued by the Commission in the aforesaid decision within one week from the date of receipt of this order under an intimation to this Commission failing which Commission shall initiate penalty proceedings under Section 17 of the J&K Right to Information Act, 2009. The complaint for non-compliance is accordingly disposed " reads the SIC order.
