Et Plus Report Jammu, Mar 16: Principal Sessions Judge Kathua MK Hanjura has denied bail to two accused who had been caught allegedly with banned capsules by the police. According to the police Surinder, Manjeet Singh and one of their associate broke into a run on seeing a police patrol party after which they were chased and caught by the police. "On search capsules of PARONE SPAS in the quantity of 950 were recovered from Manjeet and 60 capsules of the similar make and brand were recovered from Surinder," police said. A case u/s 8/21/22/27/29 of NDPS Act was registered. The court after hearing Advocate TN Gupta for the petitioner and Public Prosecutor Ravi Kumar Gupta for the state, observed that the instant petition from perspective of what is stated in the notification, the entire mixture or substance of a particular drug is relevant from determining the quantity of drug and not its pure content. "The weight of seized capsules has been stated to be 638 grams. This attracts that bar created by section 37 of NDPS Act and therefore, the application of petitioner does not deserve any consideration at this stage and accordingly dismissed. (JNF) |
