How wages drawn without records, questions CIC | Appointment of consolidated workers in JKPCC | | Early Times Report SRINAGAR, Aug 8: An scam of illegal appointments has surfaced in the J&K Projects Construction Corporation (JKPCC) wherein scores of workers (more than 40 ) have been illegally appointed since last few years on consolidated basis. According to sources most of the appointees have paid bribe in lieu of the appointments. When a whistleblower Zahoor Ahmad Dar sought the names of such appointees under J&K RTI Act 2009 the Public Information Officer (PIO) of JKPCC who happens to be the Financial Controller of the Corporation denied to provide the same. An appeal was also moved by the RTI applicant before First Appellate Authority (FAA) of JKPCC (GM) but the details of the illegal appointees was not given. The case finally landed in State Information Commission (SIC) and the Chief Information Commissioner (CIC) GR Sufi directed the PIO to disclose the names. The CIC lambasted the PIO for withholding the said information. As per details available with Early Times a complaint filed by a whistleblower Zahoor Ahmed Dar a resident of Panzan Chadoora in Budgam district State in the State Information Commission (SIC) on 4.2.2013 complaining therein that the Commission's order dated: 09.1.2013 was not complied by the PIO. The hearing of the appeal was fixed on 3.7.2013 vide this Commission's Registry Notice No: SIC/CO/SA/115/2012-1276-78 dated: 19.06.2013. The PIO JKPCC who is also the Financial Controller of the said Corporation attended the hearing. He stated before the Chief Information Commissioner (CIC) that he passed order on 19.01.2013 which is well within the directions of the Commission. The complainant during the hearing confirmed of having received the copy of order but insisted that the information so given was not complete and in certain respects was incorrect. The Commission has accordingly compared information given by the PIO . It was found that details about consolidated workers was not provided by the PIO . The RTI Applicant asked various details from the PIO of JKPCC and among it he sought following important information which was deliberately hidden by him . Name the consolidated workers who have been engaged directly on consolidated basis in the Corporation? Complainant Zahoor Ahmad Dar had sought names of the consolidated workers who were engaged directly on consolidated basis in the Corporation. The PIO in his order referred that there was no proper record pertaining to engagement of these workers. The PIO further submitted before the Chief Information Commissioner (CIC) that the complainant had not asked the copies of orders. He had simply asked the names. The order passed by the CIC GR Sufi reads: "However, the Commission has considered the gravity of the situation. The PIO has not obviously come out with full names on the plea that there was no proper record. Commission is at a loss to understand how without record, wages were drawn by the DDO and amount was ordered to be released by the AAO. This information be collected from wage Bill section and Assistant Accounts Officer. The Commission, for bringing transparency and accountability in the system, has ordered for disclosure of such information though admitting the PIO's submission that this information i.e list of such employees were not asked by the complainant. This information be provided to the information seeker within 15 days from the receipt of this order. The complaint is accordingly disposed of subject to the implementation of directions made above " When contacted Zahoor Ahmad Dar said "than some names have been provided by the PIO but still some names are yet to be disclosed by him " . This is again violation of the order of State Information Commission he added. |
