| DB grants 4-weeks time for filling reply | | PIL regarding collection of taxes from pilgrims at SMVDS | | Et Report Jammu, Sept 9: In a Public Interest Litigation filed by SOS International and others in which it has been submitted that tax is being collected from the pilgrims visiting Shri Mata Vaishno Devi Shrine for the services rendered by Pouny/Pithoos (labour)/ Palkiwalas u/s 66 of J&K Municipal Act, the Division Bench of High Court observed that pursuant to the last order dated July 31, 2013, Registry has tagged the record of OWP 2002/2006. The DB comprising Justice Virender Singh and Justice Ali Mohammad Magrey after hearing advocate Abhinav Sharma appearing for the petitioner and AAG Seema Shekhar for the state, advocate Rohit Kohli for the Shrine Board observed that reply has already been filed on behalf of respondents except Chief Secretary and Deputy Commissioner Reasi. At this stage AAG Seema Shekhar seeks four weeks time to file reply on behalf of Chief Secretary and Deputy Commissioner Reasi which was granted by the DB. The DB ordered that interim direction passed on July 31, 2013 ("whereby on July 31, 2013 it observed that keeping in view the totality of facts and circumstances and the detailed reply filed by the Shrine Board highlighting the facilities being provided to the pilgrims, it becomes imperative to stayed the operation of SRO 198 dated April 2013 so far it relates to management of track vis-à-vis the ponies/pithoos and palkies right from Darshani Deodi Katra upto the Holy Cave which would include infrastructures of track as well which is already under the management of the Shrine Board, ordered accordingly, Court observed and deferred the consideration of the other aspects of the matter as highlighted in the PIL. According to the SRO 198 of 2013 dated April 2013, Municipal Committee Katra will now start claiming management of the entire track from Darshani Deodi Katra upto Holy Cave which is being continuously managed by the Shrine Board Since it inception") vis-à-vis staying of SRO 198/2013 to continue to till further orders.
