| Court awards life imprisonment to father, son and servant | | Murder of Imam of Jamia Masjid | | early times report
Jammu, Oct 14 (JNF): In a sensational murder of one Mohd Yasin Wani Imam and Mousin of Jamia Masjid Heerpora Shopian who was murdered in year 2007, today Principal Sessions Judge Shopian Raja Shujat Ali Khan awarded rigorous life-imprisonment and fine Rs 50,000 each to Ab. Rashid S/O Ahsan Wani R/o Dachnoo Heerpora, Sajjad Ahmad Wani S/O Ab. Rashid Wani R/O Heerpora Dachnoo and Mohd Rafiq Takkar S/O Juma Takkar R/O Kothada Sankari Rajourie present Heerpora Shopian. Court further observed that the fine so imposed on on its realization is ordered to be paid as compensation to the widow of the deceased.
This murder turned very sensational one and was subject matter of large scale public protests and demonstrations held in the District in 2007. It was because of the fact that deceased was Imam and Mouzin of Jamia Masjid Heerpora Shopian and was reciting Azaan of "Nimaz Isha" on the relevant date in the Mosque when he was hit by the convicts by the Axe at his head from behind, his brain matter came out. He fell down and died then and there.
The motive behind the murder as established during trial is that convict Ab. Rasheed is an employee of Agriculture Department and the office of the Agriculture Department was in the house of the deceased, where he developed acquaintance with the family of the deceased and even got his son engaged with the daughter of the deceased. In the meanwhile some of the land of deceased came under the Mughal Road Project for which deceased got some compensation as well and out of that a portion was taken by the accused Rasheed Wani as well who also wanted a piece of land for construction of shop on the Mughal Road from the deceased which he denied. In the meanwhile deceased suspected some illicit relations between accused Rashid Wani and his wife and warned accused Ab .Rashid Wani not to visit their home and even broke the engagement tie of his daughter as well. Accused Ab.Rashid Wani had a evil eye on the whole property of the deceased and made a plan to eliminate him and grab whole property of the deceased with the help of his son Sajjad Ahmad Wani and servant Mohd Rafiq Takkar attacked the deceased in the Mosque when he was reciting the Azaan and killed him with a design to brand the same to the militants/Ikhawanis but to his mis-fortune he was spotted by some local who had come to offer prayer.
Principal Sessions Judge Shopian Raja Shujat Ali Khan after hearing Public Prosecutor Mr. Imtiyaz Ahmed Khan for the state whereas Advocates Mohi-u-din Perwaiz and Molvi Shabir Ahmad appeared for the accused persons observed that the authoritative precedents relating the subject guide me to the opinion that the case in hand is not rarest of the rare case and convicts do not deserve capital punishment as envisaged u/s 302 RPC and awarded rigorous life-imprisonment to all the accused persons and fine Rs 50,000 each.
