| 12 yrs RI, fine in kidnapping, rape of minor | | | Et Report Jammu, Oct 23: Presiding Officer Fast Track Court Sanjeev Gupta today awarded twelve years rigorous imprisonment and fine Rs 27000/- to Jagjeet Rai s/o Ram Saroop r/o Khalas Kullian RS Pura who was facing trial in kidnapping and rape with minor. Court further said that the fine be deposited and out of it 20,000 paid to prosecutrix. According to the police case that on October 21, 2006, father of the prosecutrix lodged a written report with P/S RS Pura that his daughter aged 15 yrs was missing on October 7, 2006 from his house and alleged that he came to know that his daughter had been enticed away by the accused to some unknown place. On this police registered a case and recovered prosecutrix and presented challan in the court of law. Presiding Officer Fast Track Court Sanjeev Gupta after hearing Public Prosecutor GS Charak for the State whereas Adv Vivek Sharma for the accused found the crime of rape which is a heinous offence and a crime against society and also crime against dignity. To view such an offence once it is proved, itself an affront to the society. Though the award of maximum punishment may depend upon the circumstances of the case, the award of minimum punishment generally is imperative and awarded five yrs RI and fine Rs 20000/- u/s 363 RPC and 7 years rigorous imprisonment and fine Rs 25000/- RPC. Court further clarified that both the sentences shall run concurrently. (JNF) |
