J&K HC disallows PIL, says court is not post office

Srinagar, Nov 1: Dismissing a Public Interest Litigation (PIL), seeking direction to state to divulge information about construction of toilet and other works in Shopian district of south Kashmir, Jammu and Kashmir High Court observed that courts cannot be allowed to be converted into a 'post office'.
A PIL was filed by Tariq Ahmad Shah and others seeking directions to the state government to give information about construction of toilets on the banks of the river Singloo and other streams in the district.
The petitioners had also prayed that Deputy Commissioner (DC) and Executive Engineer Roads and Buildings (R&B) of the district be directed to furnish a detailed report about the measures taken by the department on the widening of roads, illegal constructions along the roads and also funds sanctioned and utilized.
They had also sought directions on No Objection Certificate (NOCs) and other permissions granted by DC for converting agricultural land for commercial activities.
They had further sought that the DC and Deputy Director Consumer Affairs and Public Distribution (CA&PD) be directed to furnish a detailed report about the issuance of BPL cards.
However, a division bench of the court, comprising Justices Mznsoor Ahmad Mir and Ali Mohammad Magrey dismissed the PIL saying that the petitioners do not seek any positive direction which could have benefit the general public.
The court said the petitioners want this court to seek certain information which can be obtained under Right to Information (RTI) Act from the concerned authorities.
The bench said in the garb of PIL, the court cannot be allowed to be converted into a post office for requisite information from the government.
Disposing the petition, the court, however, said it is expected that the State and its concerned functionaries would take all possible measures to redress any grievance of the locals of the district with regard to the issues raised in the petition in accordance with rules.
