5 yrs RI to accused facing trial in attempt to murder case

Jammu, Nov 1(JNF): Principal Sessions Judge Poonch Jaffer Hussain Beigh has awarded five years rigorous imprisonment and fine Rs 10,000 to one Shakoor Ahmed who was facing trial in attempt to murder case for the last 9 years.
Court also issued arrest warrants against one Mohd Iqbal.
According to police case that 23.8.2004 the complainant, Bashir Ahmed along with injured Mohd Farooq ,Shamima Akther and Mohd Sakinder filed an application before Police Station Surankote against the accused with contention therein that due to strained relationship between accused No.1 and the father of the complainant over a piece of land ,on the previous night when he and his two nephews namely Mohd Sakinder and Maroof were returning from a marriage party, were wrongfully restrained and assaulted by the accused on the way.
The accused also took Mohd Sakinder with them and kept in wrongful confinement in a room, tied and beat him. Next morning he called his brother Mohd Farooq and informed him that his son has been confined throughout night by Rahima and his family members. As soon as Mohd Farooq and his wife came to rescue their son, the accused started beating them as a result of which they received grievous injuries.
On receiving this complaint FIR No.132/2004 for commission of offences u/s 147,323,341,342 RPC stood registered in Police Station Surankote with which police started investigation. After completion of investigation challan was presented.
Principal Sessions Judge Poonch Jaffer Hussain Beigh after hearing Public Prosecutor Nazir Hussain for the state whereas Adv Raja Mohd Abbas Khan for the accused persons convicted Mohd Shakoor and Mohd Iqbal and sentence accused, namely, Shakoor Ahmed to undergo rigorous imprisonment for five years and to pay a fine of Rs.10,000/- and in default of payment of fine he shall further undergo imprisonment of like nature for 6 month for the commission of offence under section 326 RPC, also to undergo rigorous imprisonment for one year and to pay a fine of Rs.1000/-
All the sentences of rigorous imprisonment shall run concurrently and shall commence at first and the sentence of simple imprisonment shall commence after the expiry of rigorous imprisonment.
Court further observed that the accused Mohd Iqbal has remained continuously present throughout the proceedings of trial till the conclusion of final arguments but on the date of announcement of judgment only he remained absent. He is to be heard on the question of sentence, so non bailable warrant for his arrest is issued which shall remain in force until it is executed and the said accused is brought before the court.
