| DB directs State to divulge names of illegal occupants of 20 lakh kanal of state land | | PIL against alleged land-grabbing by politicians, top bureaucrats | | Et Report
Jammu, Nov 4: In a much publicized Public Interest Litigation against alleged nexus of politicians, police officers, bureaucrats and land mafia in various parts of J&K for allegedly grabbing the state land, when this PIL was taken-up today State again sought adjournment to comply the direction asking the State to divulge the identity and names of illegal occupants of 20 lakhs kanal state land, on the other side Advocate Sheikh Shakeel Ahmed appearing for the PIL has emphasized that information would be available with the respondents when the concerned department has answered the starred question on the floor of the State Assembly by stating that more than 20 lacs lanals of state land is under illegal occupation of various persons. A Division Bench of State High Court Comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Adv SS Ahmed appearing for the PIL whereas Senior Additional Advocate General Gagan Basotra appearing for the state, took serious note that in this matter repeated adjournments have been sought to comply with the direction asking State to divulge the identity and names of illegal occupants of the state land so as to decide further course of action and granted one last opportunity to State to furnish the information within two weeks and directed Registry to list this PIL on November 25, 2013. In an application filed one Ram Krishan r/o Bhagwana Chack Tehsil Hiranagar and District Kathua filed an application for intervening in the PIL on the ground that he pointed out certain encroachments regarding the illegal/ unauthorized occupation of 189 kanal and 01 marla of state/ common land bearing khasra no.1020/471, 719, 671, 670, 561,564,666, 665, 7 Kanal 5 Marla bearing Khasra no. 25 (Shamshan Ghat), 36 Kanal 8 Marla bearing Khasra no. 244 (Mafide-aam) and 8 Kanal 11 Marla bearing Khasra no. 381 (Pond/Talai), situated at village Bhagwana Chack, Tehsil Hiranagar & District Kathua to the notice of Deputy Commissioner Kathua and Tehsildar Hiranagar but no action has been taken against the powerful encroachers. The applicant alleged that till date the expiry of more than one year the encroachment in question has not been removed as the encroachers are musclemen and resourceful person and are being shielded by the politicians and revenue officials. Division Bench also directed State to file reply in this application and also, in case reply is not filed then the issue concerning means profits shall be taken up on the next date of hearing.
