| Court awards life-imprisonment to accused in murder case | | | ET Report
JAMMU, Nov 30 : Principal Sessions Judge Bhaderwah MK Sharma today awarded rigorous life-imprisonment to Mohammad Iqbal son of Imam Din Jaral resident of Mangota Tehsil Doda who was facing trial in murder case for last 9 years. Principal Sessions Judge Bhaderwah MK Sharma after hearing both the sides The prosecution has, therefore, proved the commission of offence under section 302 RPC & 4/25 Arms Act against the accused. The accused is accordingly held guilty and convicted for the commission of offences under sections 302 RPC and 4/25 Arms Act. Court further observed that the offence u/s 302 RPC is punishable with death or imprisonment for life and with fine. This is a case of murder. The attending circumstances of the case does not warrant extreme penalty of death sentence. Though a young person of 35 years has lost life in the instant case by the act of the accused but it does not fall in the category of rarest of rare cases where the death sentence is warranted. The convict is, therefore, sentenced to undergo rigorous imprisonment for life and fine of Rs. 5,000/- for the commission of offence u/s 302 RPC. In case of default in payment of fine the convict shall undergo further simple imprisonment of two months. The convict is also convicted for the commission of offence under section 4/25 Arms Act and sentenced to undergo rigorous imprisonment for a period of one year and a fine of Rs. 1,000/-. In default, the convict shall undergo further simple imprisonment for 15 days. The period of detention already undergone shall be set of. Both the sentences shall run concurrently. (JNF) |
