S Sabaqat Srinagar, Nov 30: Court of Special Judge Anti-Corruption Kashmir, Mohan Lal Manhas today heard the arguments in the bail plea by Sajad Ahmad, one of the accused in paper selling scam of BOPEE. The judge heard at length CPO Crime Branch and counsel for Sajjad. However the arguments could not be completed today and will continue on Monday. In his arguments, CPO said that Sajad has committed more “heinous a crime than murder.” The CPO said that involvement of Sajad is not based only on the statement given by Farooq Ahmad itoo, kingpin in the scam, but other evidence as well. “There is well founded evidence against Sajad which his counsel has no access to,” the CPO said. Following this, the court told him to produce case diaries in the case on Monday. Revealing Sajjad’s involvement, the Crime Branch said that he received question papers of Physics, Chemistry and Biology from Itoo at Nishat and distributed it among various candidates through Haroon Rashid of Dayalgam, Anantnag, who has remained his classmate at Bangalore. “Sajad received huge amount from Haroon and others and thereafter provided them the question papers,” the Crime Branch said. “Out of this amount, a portion was paid to Itoo.” The investigating agency said that it was expecting some disclosures from Sajad which may lead to recovery of some vital evidence in the shape of bank accounts, call details, identification of touts or candidates in other districts of the state. “The investigation has established that (Sajjad) has committed a grave and serious offence which led to the selection of undeserving candidates for undergoing MBBS course,” the Crime Branch said, seeking dismissal of the application for bail moved by Sajjad. “The accused, on account of the gravity of the offence, is not entitled to claim the bail. That in case the accused is released at this stage, he will definitely outlaw himself and will use his liberty to suborn the evidence.” The Crime Branch said that since investigation of the case is in progress, releasing Sajad on bail will cause “prejudice to the investigation because there is every likelihood of destruction of prosecution evidence by him.” Further, the Crime Branch said that if Sajad is released, he will definitely jump over the bail and will try to win over the witnesses. The arguments in the bail plea by former chairman of the BOPEE, Mushtaq Ahmad Peer, is also expected on Monday.
