| Seven years RI awarded to Rapist | | | EARLY TIMES REPORT
Jammu, Jan 1 : Principal Sessions Judge Poonch today has awarded seven years rigorous imprisonment and fine Rs 10,000 to Pervez Ahmed alias Raju who was facing a trial for his alleged involvement in a rape case. After hearing Choudhary Nazir Hussain, Public Prosecutor for the State whereas Adv Sunil Sharma for the accused person, Principal Sessions Judge Poonch Jaffer Hussain Beigh observed offence under section 376(1) RPC committed by the accused is punishable with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years, and shall also be liable to fine. "The trial in this case has taken about a decade and sentenced accused namely, Pervez Ahmed alias Raju S/O Nazir Hussain Caste Gujjar, R/O Khanetar Tehsil Haveli District Poonch to undergo rigorous imprisonment for seven years and to pay a fine of Rs.10,000/- , court said According to the case that a report lodged by prosecutrix at 15.00 hours on 6th May 2003 at the aforesaid Police Station that the accused, her neighbourer, for the last two years was forcing her to marry him but she refused to marry her and even started threatening her through militants. Finally, the accused promised to marry her and deceitfully committed rape upon her and thereafter the accused continued to have sexual relations with her against her consent as a result she became pregnant and gave birth to a female child on 28.4.2003 at Hospital Poonch even then accused refused to marry her. On this FIR No.50/2003 of the year 2003 for commission of offence u/s 376 RPC stood registered in Police Station Poonch and after completion of investigation challan was presented. JNF |
