Srinagar, Jan 1: Division Bench of Jammu and Kashmir High Court has hoped that the state government will lead country by making the Prevention of Corruption Act stringent, more effective and more deterrent. Division Bench comprising Justice Virender Singh and Justice M H Attar said in an order while hearing a Public Interest Litigation-Mohammad Amin Beigh v/s State. "The earnest and sincere efforts of Court are to ensure a corruption free society, court observed and added, " in a democratic society, the only method and mechanism to fight the evils, is through process of law.' "The evil of corruption has taken the shape of a monster. The law, which the State needs to deal with this huge monster of corruption, has to be very strong,' it underlined, further adding, "the laws for fighting corruption have to be made so strong that while grappling with this evil force same do not break." "It is the duty of State to provide effective and deterrent legal mechanism to deal with the menace of corruption," court said. Pertinently the Division Bench had recorded suggestions made at the bar on 7 July last year and had observed that while making recommendations for amending anti-corruption laws, the government/authorities, will keep in mind these suggestions. "The brunt of the corrupt activities of few people is being borne by majority of population, the court said. "To us, the recommendations made by the Committee to the Government for making amendments in the prevention of Corruption Act, appear to be an eye wash. The State Government shall have to re-consider the whole issue in the light of suggestions made by the Court in order dated 04 of July. 2012," the court said. "The State of J&K, through Chief Secretary, to take into consideration the observations made in this order and proceed in the matter so as to secure the public interest, which is of paramount importance to all the constitutional authorities," the court said. |
