| Fast Track Court acquits rape accused as prosecutrix declared 'hostile' | | | Early Times Report
Jammu, Jan 11 :: Presiding Officer Sanjeev Gupta of Fast Track Court constituted to deal with the cases related to women today decided a rape and kidnapping case within the short span of three months and acquitted accused Rakesh Singh from the charges leveled against him as prosecutrix declared hostile. While acquitting the accused person Rakesh Singh s/o Onakar Singh r/o Rajpura Pargwal Tehsil AKhnoor, Presiding Officer Sanjeev Gupta observed that from the perusal of evidence of prosecutrix, there is nothing to suggest that accused had committed the offence with which he has been charged because prosecutrix has specifically stated during the course of testimony that the accused has neither done any bad act with her nor cheated her. Court further observed that prosecutrix has not supported the prosecution case. In these circumstances, Court left with no option but to truncate the proceedings against the accused and thus the prosecution case is dismissed and accused is acquitted. Court further directed that accused is in police custody and he shall be released forthwith if not required in another case. JNF |
