| HC frowns adhocism 'plague' in Health department | | | Early Times Report SRINAGAR, Mar 29: Expressing serious concern over non-compliance of its order regarding filling of posts at higher-level through regular promotions, a special Division Bench frowned at J&K Health and Family Welfare Department for continuing with adhocism. "Perusal of the statement of facts and affidavits when read together with the statements already filed would indicate that no significant steps have been taken by the respondents towards implementation of order 01-01-2013," the Division Bench comprising of Justice Hasnain Massodi and Justice Janak Raj Kotwal said. Repeated requests, reminders and directions to respondents to implement order dated 01-01-2013 in letter and spirit, the Division Bench said, have gone waste and unresponded," the Division Bench said. "The irresistible conclusion one may draw from the above situation is that adhocism plague the Health and Family Welfare Department from top to the bottom," the Bench said, and added: "We are short of words to express our dismay and displeasure over apathetic and indifferent approach shown by the respondents in implementing order dated January 1, 2013. One and quarter year by any standard is sufficient to substantively fill up 3 posts of Directors, 8 posts of Deputy Directors and 48 posts of CMO’s etc. The respondents have not taken even initial steps towards regularization in the department." After hearing all the parties, the Bench direct respondents to file a fresh status report, indicating all the proposals forwarded to J&K Public Service Commission in connection with the implementation of order dated 1-1-2013. "The information must relate to confirmation of Doctors/Consultants at all levels--deputy Director, Senior Consultants, CMOs, Superintendents of Hospitals, B-Grade Specialists, Director TB Demonstration Centre, Assistant Directors. It must also indicate communication, if any, received from J&K PSC including deficiencies in such proposals identified by the Commission as also, steps taken to make good the deficiencies," the court said. The Division Bench also directed J&KPSC to file a detailed status report indicating the proposal received from Health and Family Welfare Department regarding confirmation of officers -Directors, Deputy Directors, senior Consultants, CMOs etc-- at different levels. "The steps taken by the Commission to take decision on such proposal and deficiencies, if any, identified and communicated to respondent department and response received." The Division Bench also directed the respondents as well as JKPSC also explain delay in identifying the deficiencies and in responding to communications received in this regard. "It is only after information is made available that we would be in a position to deal with the request of Kawoosa for dispensing with the presence of Commissioner/Secretary to Government Health and Medical Department to explain delay in implementation of order dated January 1, 2013," the Division bench said, posting the case filed by one Dr Mohammad Ashraf, for further consideration on April 11. |
