| DB directs CS to file status report with regard to stand of SSP Jammu | | PIL regarding encroachment of State Land | | Early Times Report
Jammu, Apr 24 : Taking serious note of statement made by the SSP Jammu in response of VC Jammu Development Authority (JDA), that the police force is not available till election process is over for evicting the 400 Kanal land at Gole Gujral, Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain observed that officer like SSP should not make such statement and directed the Chief Secretary to take notice of such like violations and direct the authorities concerned like SSP Jammu to maintain propriety of his office.
When Public Interest Litigation (PIL) against alleged nexus politicians, police officers, bureaucrats allegedly in connivance with land mafia in various part of J&K for allegedly land-grabbing was taken-up for hearing, a Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain today taking serious note of the statement made by the SSP Jammu in response of VC JDA that the police force is not available for evicting the 400 Kanal land at Gole Gujral till election process is over in the State and Division Bench requested M I Qadri, Advocate General, who is present in the Court, that officer like SSP should not make such statement because it leads to unhealthy impression and encourage the mafia at various level.Upon this Division Bench directed that the request of JDA for police help must be responded at earnest so that effective steps could be taken for removal of encroachers. "A status report in that regard shall be filed by the Deputy Commissioner and also directed the Chief Secretary to take notice of such like violations and direct the authorities concerned like SSP Jammu to maintain propriety of his office, the division bench said. Even otherwise "we do not appreciate the SSP to make a statement on behalf of the police in the whole State."Division Bench failed to understand who authorized SSP Jammu to make such a statement and directed Chief Secretary also file a status report with regard to the stand of the SSP, Jammu.It was also brought to notice of Court a status report filed in pursuance of order dated March 18, 2014 and from the perusal of the status report it seems that the Senior Superintendent of Police, Jammu has stated in a meeting with Deputy Commissioner, Jammu that the police force is not available till election process is over in the whole State, while in its order on 18/03/2014, Division Bench had issued direction for eviction of the encroachers from the JDA land. "If the election process is taking place in one area of the State, the other areas cannot be left without law enforcing agencies, court said. Division Bench further observed that there is no complete compliance and directed that by the next date of hearing complete compliance report has to be filed and sent a copy of this order to the Chief Secretary for compliance. Division Bench also directed Director State Vigilance Organization that he shall also file updated status report revealing all the progress made during the intervening period. Meanwhile a fresh application was filed stating that State has transferred more than 77124 Kanals land to the JDA but only 7653 Kanals land has been handed over and more than 50 letters written by JDA to Revenue Dept for demarcated rest of the land, there is no response from Revenue, Dept, Division Bench issued notice which was accepted by Additional Advocate General HA Siddiqui for the state.(JNF) |
