| BOPEE scam: HC dismisses anticipatory bail pleas by 2 forest officers | | | Early Times Report SRINAGAR, May 27: A Division Bench of Jammu and Kashmir High Court has dismissed anticipatory bail applications by two forest officers, who are evading arrest in connection with their alleged involvement in multi-million cash-for-paper scam engineered by former chairman of BOPEE Mushtaq Ahmad Peer. "It is quite disheartening to notice that allegedly fathers of the students have stooped low so as to purchase papers and ensure position of their sons in the merit list of the students for admission to MBBS course," the division bench comprising Justice Mohammad Yaqoob Mir and Justice Hasnain Massodi said while dismissing bail applications of Mohammad Amin Mir and Altaf Hussain Shah, both forest officers. The court also observed that it is true that the personal liberty guaranteed under article 21 of the Constitution of India is of great importance. "Incarceration is permissible only after accused is convicted and sentenced but grant of bail to safeguard personal liberty is controlled by reasonable exception," the court said. Recently, the Special Anti-Corruption Court here issued warrants for attachment of property of the duo as also six other accused, evading arrest for their alleged involvement in the scam of Common Entrance Test 2012. |
