| Court acquits accused for want of evidence | | Lady killed by alleged LeJ Militants | | Jammu, May 27 : Principal Sessions Judge Bhaderwah MK Sharma has acquitted Abdul Gani Code Hamar Son of Ali Mohammad resident of Chanyas Tehsil Gandoh District Doda alleged militant of Lashkar-e-Jabbar, as there is not even an iota of evidence to connect the accused with the commission of offence of which the accused is charged. According to the brief history of the case , on June 29, 2003 at night the deceased Mastoora Bano was present in her house alongwith other family members at village Sanwara when some terrorists entered the house and took away the deceased Mastoora Bano out of the house at some distance and shot her dead. The terrorists did not allow the other members of the family including the father to come out of the house. After the terrorists disappeared, the family members reached on spot and saw the deceased lying in pool of blood. The terrorists had also kept a handwritten letter allegedly issued by Lashkar-e-Jabbar organization near the dead body. On the strength of written report lodged by one Khan Mohammad father of the deceased through his brother Wali Mohammad, Crime No. 55/2003 for the commission of offences under sections 302/458 RPC 7/27 Arms Act was registered in PS Gandoh. After completion of the investigation challan was presented. After hearing both the sides, Principal Sessions Judge Bhaderwah MK Sharma observed that there is not even an iota of evidence to connect the accused with the commission of offence of which the accused is charged. The challan, therefore, fails. The accused is acquitted of the charge. The accused who is in custody is ordered to be released forthwith provided he is not required in any other case. |
