| HC directs 2 ITBP officers to appear before Police | | | Early Times Report
Srinagar, May 30: The Jammu and Kashmir High Court has directed two officers of ITBP to present themselves before the investigating officer in connection with case involving alleged abduction and disappearance of youth from Anantnag district in 1991. The directions were passed by a single bench of the court comprising Justice Hasnain Massodi on a petition filed by Ghulam Hussain Koka, father of youth Mohammad Ashraf Koka, who was picked up from his residence by ITBP personnel of 10th Battalion at Dooru Verinag on 27-10-2001. Father of the victim approached High Court, seeking direction for speedy investigation which was entrusted to SP Headquarters Anantnag. The Investigation Officer on 3rd May 2012 appeared in court and stated that accused involved in alleged abduction and custodial disappearance were identified and to take the investigation to its logical end were to be got identified by the witnesses in a test identification parade. He further stated that the Commandant of the 10th battalion was not cooperating with the investigating agency which had approached Chief Judicial Magistrate Anantnag with a request to issue warrants against the identified personnel so as to secure their presence. Some of the persons named by the witnesses in their statement under section 161 CrPC have since appeared and test identification parade has been conducted. However, court said, their mere appearance before IO would not satisfy the mandate orders passed from time to time since 3 May 2012. "Investigating officer is directed to conduct identification parade qua Inder Singh Negi and Dr P S Gunjiyal within two weeks," the court said. The personnel, court said, shall appear before the IO so that date of identification parade is fixed and the investigation is concluded without any further delay. |
