| DB issued directions to Commissioner SWD,DGP J&K | | PIL seeking implementation of Beggary Act 1960 | | Early Times Report Jammu, May 30 : In a Public Interest Litigation filed by practicing Lawyer Adv Parimoksh Seth seeking directions to the respondents to implement the provisions of the Prevention of Beggary Act, 1960 and Prevention of Beggary Rules in the State of J&K and to stop the menace of begging especially organized begging in the State of J&K, A Division Bench of State High Court comprising Justice Mohammad Yaqoob Mir and Justice Dhiraj Singh Thakur today after hearing Sr. Adv Sunil Sethi with Adv Veenu Gupta appearing for the PIL observed that in response to the directions, contained in the order dated March 6, 2014, compliance report on behalf of the Director General of Police has been filed, copy whereof has been furnished to Advocate for the PIL, who shall file his response by or before next date. A perusal of the compliance report is also suggestive of the fact that the Jammu and Kashmir Prevention of Beggary Act, 1960 is not applicable in most of the districts. The government may consider extension of its applicability to all the districts wherever it is not already applicable. Division Bench further observed that the Social Welfare Department has not till date filed its response/status vis-à-vis directions as were contained in of the order dated March 6, 2014 and Sr. AAG Gagan Basotra seeks four weeks' time for filing latest status and directed that in case of any further slackness, the Commissioner Secretary to Government, Social Welfare Department to remain present in person on next date. Division Bench after gone through the status report directed DGP shall ensure that effective steps are taken for tracing out the missing persons/kids as made mention of in the report.(JNF) |
