JAMMU, June 3: In an obvious bid to hoodwink court direction, Kalakote Police has dragged a man into another case after the Court stayed FIR registered against him in an alleged dowry case filed by his estranged wife. According to documents available with the Early Times, the High court on May 26 last had stayed an FIR registered against Mohd Shabir son of Mohd Yousuf resident of Sounchal, tehsil Kalakot, District Rajouri and others, as well as directed the concerned police not to act upon FIR number 8/ 2014. Asmat Begum wife of Mohd Shabir, had filed a case of dowry against her husband and acting on the complaint Kalakote police registered a case against FIR No 8/2014 under section 489-A/109 of Ranbir Penal Code (RPC). Meanwhile, Mohd Shabir appealed before the court against the FIR. "On May 26, 2014 the bench of Justice Tashi Rabstan of High Court Jammu after going through the case brought before him stayed the FIR and issued notice to police, returnable within four weeks," the court orders read. When contacted, SHO Kalakote, Vikram Parihar said that the police has arrested Mohd Shabir in an absconding case as he was wanted in a case since 1998. "An FIR number 6, 1998 under section 512 stands against him at Police Station Kalakote, police have arrested Mohd Shabir today from his residence", said SHO Kalakot. However, the family members of Shabir are ridiculing the police action and termed it as an act taken at the behest of Asmat. Contradicting police's argument that Shabir was an absconder, the family members of the victim alleged that earlier in January of this year, Kalakote police nabbed him for allegedly harassing his wife Asmat but the men in khaki released him after getting favours in kind and cash. "Shabir was released same day by police after getting bribe including cash and solar light," the family members alleged. Terming the arrest of Shabir as a desperate action taken in vengeance by the police as he knocked the doors of court, the family members of Shabir said that he is being victimized adding that police's high handedness could be gauged from the fact that it registered a false dowry against nine persons including family members and relatives of Shabir. "Police booked nine persons including three relatives who reside at Kotranka and who have nothing to do with the alleged complaint", Mohd Zaman maternal brother of Shabir said. |
