| Court arrayed four accused in MMS Scam left out by Investigation Officer | | 'Main accused directed to furnish bail bond of an amount of Rs.30,000 | | Jammu, June 20 : Principal Sessions Judge Poonch JafferHussainBeigh arrayed four accused namely GurdeepKour, Gagan Deep Singh, Ramandeep Singh alias Karanjeet Singh and Balvinder Singh as accused in much publicized MMS Scam of Poonch District. Meanwhile court accused Balvinder Singh present in the court is directed to furnish bail bond of a respectable person for an amount of Rs.30,000/- While hearing the case, Principal Sessions Judge Poonch observed that after committal of the case by the CJM Poonch was received by this Court on 23/1/2014. Principal Sessions Judge Poonch after referring various judgments of the High Court and Apex Court observed that Sessions Court has power to summon additional accused though no evidence has led before the Court and trial has not commenced in case the person, has not been named in the police report as accused, has power to do so u/s 193 on basis of documents on record.
"Therefore, without returning any findings thereon the application of the prosecution is allowed and the non-applicants namely Gurdeep Kour, Gagan Deep Singh, Ramandeep Singh alias Karanjeet Singh alias Aman and Balvinder Singh, driver of SHO Police Station Poonch are arrayed as accused and accused Balvinder Singh present in the court is directed to furnish bail bond of a respectable person for an amount of Rs.30,000/- and also his own personal bond of like amount before this court for his attendance till the order for charge/discharge is passed in default of which he be kept in judicial lock up at District Jail Poonch. Bailable warrants to the tune of Rs.30,000/-against the other accused namely, GurdeepKour, Gagan Deep Singh and Ramandeep Singh alias Karanjeet Singh alias Aman be issued for their appearance before the court on the next date of hearing. During the course of preliminary argument on charge/discharge of the accused when it was found that the Investigating Officer had not arrayed the non-applicants GurdeepKour d/o Preetam Singh, Gagan Deep Singh s/o Kulbir Singh residents of Village DarraDullian Tehsil Haveli District Poonch, Ramandeep Singh alias Karanjeet Singh alias Aman s/o Raghbir Singh r/o Khorinar W-8 Poonch and Balvinder Singh, (driver of SHO Police Station Poonch) s/o Rangil Singh r/o Mangnar Haveli District Poonch as accused in case FIR No.106 of the year 2013 for commission of offences u/Ss 376, 366, 342, 201, 109, RPC and 67,67-A, IT Act, the application was moved by the Public Prosecutor on 28/1/.2014 for arraying them as accused on the grounds that the prosecutrix in her statement recorded u/s 164-A Cr.PC has categorically deposed that non-applicants 1 to 3 have abetted the commission of offences u/s 376 RPC and non-applicant with criminal intention has displayed the video film of the prosecutrix and the accused on the internet but the Investigating Officer during the course of investigation did not arrayed them accused along with the present accused.JNF |
