Jammu, Aug 2 : City Judge, Jammu, Sandeep Kour has rejected the bail application of one Asgar Ali who was arrested by police in an alleged case of a minor's kidnapping and rape. According to the police case, on June 27, 2014 father of the prosecutrix lodged a written report with police post Sidhra on the ground that on the night of June 23, 2014, he was sleeping with his family in the house and in the morning of June 24, 2014 he found that his 15-year-old daughter was not at home. On June 26, 2014, he came to know that Asgar Ali, Puppy and Mukhtair Ali had come to house in the night and kidnapped his daughter. On this, police registered a FIR NO 176/2014 for the offence u/s 363 RPC and during the investigation the girl was recovered and got medically examined by police which then added section 376 RPC to the FIR. The city judge, after hearing the two sides, observed that in the instant case the fact cannot be ignored that the investigation is in initial stage and the trial is yet to commence and the prosecution has also shown apprehension of the accused absconding and tamper with evidence. She observed that the offence against the accused is quite serious in nature being committed on a minor and it will be premature and will give wrong signal to the society and will shake the confidence of the people in the court. With these observations, the court rejected the bail application. (JNF) |
