Jammu, Aug 2 : The high court has stayed the government order to transfer incharge Chief Medical Officer (CMO), Kathua, Dr Rajinder Samyal. The court directive came in a petition filed by Dr Samyal against his premature transfer within a period of six months to allegedly give benefit to Dr Raj Kumar Sangra, incharge BMO Parole who is not elegible to hold the post of Chief Medical Officer. Justice Janak Raj Kotwal, after hearing the two sides, observed that perusal of objections filed on behalf of official respondents in petition No 210/2014 would show that giving additional charge of CMO Kathua to Dr. Raj Kumar Sangra is inconsistent with the stand taken by the official respondents that he is not having requisite experience for manning the post of CMO, having regard sort by the petitioner, this petition is admitted and disposed of at its threshold by directing that respondents shall accord consideration to transfer of the petitioner in light of transfer policy issued by the government and the stand taken by them in SWP NO 210/2014. Till appropriate direction on reconsideration is taken, petitioner shall not continue as Incharge Chief Medical Officer Kathua. JNF |
