| HC seeks affidavit from SSP on Shoaib Lone’s allegations | | | Early Times Report Srinagar, Aug 8: The Jammu and Kashmir High Court today asked Senior Superintendent of Police to file personal affidavit, specifying steps taken by him for conducting further investigation into the allegations of former MLA Shoaib Lone that then Education Minister Peerzada Mohammad Sayeed and his wife had accepted and demanded bribe from him. The direction was passed by a bench of Justice Ali Mohammad while hearing a revision petition filed by state Government, challenging the order by the court of Additional Special Judge, Anti-corruption Kashmir on 16-7-2012 whereby further investigation was ordered to be carried out in case (FIR no. 2/2008 in Police station VoK under Section (2) J&K P.C. Act Svt. 2006.) The trial court had ordered further investigation as being not satisfied with the investigation by Vigilance Organization. It had asked Senior Superintendent of Police, VoK to get the investigation carried by an officer of impeccable integrity and process of further investigation be monitored by the SSP himself. “The investigation is not a mere formality and court is not expected to accept the charge sheet of the prosecution with eyes shut though at the stage of charge roving enquiry or sifting of evidence cannot be resorted to by the court for framing a tentative opinion regarding the prima-facie involvement of the accused,” the court had said. In the instant case, it had said, the investigating agency appears to have started the investigation on the complaint filed by Shoib Ahmad Lone, the MLA. The investigation officer has recorded has recorded Shoib’s statement during the course of investigation on 30-1-2008 who made startling disclosures that for approving the file regarding an institute belonging to the in-laws of Shoib’s sister, he was demanded Rs 40000 by the wife of Peerzada Mohammad Sayeed. “The Investigating Officer has not bothered to record the statement of the wife of then Education Minister besides the investigating officer has also failed to record the statement of then Special Assistant to the concerned Education Minister who as per the complainant told him that his case is rejected one which cannot be considered. In addition to this, the police officer has miserably failed to examine complainant Shoib Nabi Lone to this effect as to why he kept this startling disclosure made by him in the Legislative Assembly was kept close to his chest for more than six months,” the court had said. |
