SO Legal illegally getting benefits of CMPF | Malpractice at SMVDU | | Avinash Azad
Jammu, Oct 26: Shri Mata Vaishno Devi University (SMVDU) which is already in news for bad reasons is again in trouble as more skeletons have tumbled out in Section Officer's (Legal) domain. Sources told Early Times that deputation period of the officer was over in 2012, but with connivance of officials of accounts department of the SMVDU, the tainted LO who still working in the university, is getting benefits of Coal Mining Provident Funds (CMPF), the benefits of CMPF are given to coal mine employees only. "Legal Officer, Rajesh Kumar at Jammu Kashmir Minerals Limited, was appointed as Section Officer Legal at SMVDU for a period of three years on contract bases. Rules were also tailored to adjust the blue eyed candidate by the then Assistant Registrar by excluding mandatory education qualification as prescribed by the University statues", said insider seeking anonymity. They further said though, all the university officers appointed through open advertisement were being paid CFP and employer share as per the rules of the university but it was worth nothing here that instead of clause 3 mentioned in his offer of appointment SMVDU/Adm/09/1364-65 dated 06/05/2009 that states "your appointment shall be governed by the statues of the University" being paid extra in an extraordinary manner to shower undue monetary benefits at the cost of University exchequer. "The practice is being continued even after the cancellation of lien with effect from June 30, 2012 vide JK Minerals letter BC:3(1)13-433-38 dated June 27, 3012 that states that JKML is unable to extend the lien of incumbent beyond three years and is in process of filling the post that has fallen vacant. The copy of the latter is lying with the Finance Officer as well as Vice Chancellor of SMVDU", the insider said wishing anonymity. They further said that Finance Officer, SMVDU was not all competent to issue from VV Coal Mines Provident Fund and Coal Mines Pension Fund, form PS-5 and DLI to any the university employees. "The official documents are issued to Regional Commissioner CMPF Shastri Nagar, Jammu only by the competent JK Minerals Limited working in the Coal Mines as per the Government of India, Ministry of Labour and Employment notification dated September 27, 197", they added. The malpractice, according to them, raises eyebrows regarding involvement of some senior officials in the university administrative hierarchy without whose assistance/ confidence operation of the University bank account for issuance of demand drafts is not possible by Finance Officer at his own level in manner done in case of Rajesh Sharma. The Finance Officer Rohit K Khajuria without jurisdiction has not hesitated 'because of reasons best known to him' to sign along with using University seal on the place where only Manager or Authorized officer of coal mines can do, as specified clearly in the form PS-5 and form DLI-1 applicable to the employees working in coal mines. The finance officer, SMVDU took the responsibility from July 14, 2014 when he communicated contribution in favour of Rajesh Sharma, SO Legal for the month of April and May 2014 vide his letter number SMVDU/FIN/2014/1385-86 dated July 14, 2014 along enclosing tow demand drafts bearing number 825210 and 825274 dated July 14, 2014 and June 2, 2014 amounting Rs 12,089 and Rs 15.227 along with coal mines provident fund and coal mines pension fund scheduled (Form VV), Form PS-5 and coal mines deposit linked insurance scheme DLI-a from respectively to the officer of the Regional Commissioner CMPF Jammu. |
