Jammu, Dec 2 : Principal Sessions Judge, Kathua, Vinod Chatterji Koul has rejected the bail application of Saminder Singh (70) of Ward No 10, Kathua, who is facing trial in a murder case. Rejecting the bail application, he observed that the accusation against the petitioner is that on December 30, 2012, he abetted accused Sohan Singh and in pursuance of the said abetment, accused Sohan Singh hit the deceased with a sickle on his head with intention to kill him and as a result of the injury so sustained by him, he died the next day. The petitioner has been charged for the commission of offences under sections 302 and 109 of RPC and till date, no prosecution witness has been examined. The accusation against the petitioner is undoubtedly very serious. The court observed that the case which falls under exception to the rule that bail should ordinarily be granted. The severity of the crime alleged to have been committed by the petitioner, the supporting evidence and all other connected facts, do justify an inference that petitioner may misuse the concession of bail to escape the dragnet of law and once that possibility cannot be ruled out, the concession of bail cannot be extended. There are so many aggravating circumstances, which disentitle the petitioner from claiming the concession of bail. With these observations, the court rejected the bail application. (JNF) |
