HC’s directive on parking, security of advocates | | | Jammu, Dec 2 : In a PIL filed as regards parking, new road, health centre and security of advocates, judges and litigants, a high court division bench of Chief Justice M M Kumar and Justice Tashi Rabstan observed that the J&KPCC counsel has pointed out that a total amount of Rs 908 lakh has so far been released between 2006 to September 2014. The value of the work done on the spot as per the estimate is Rs 1115.20 lakh as on October 2014. The entire work has come to stand still for want of funds. The bench observed that in response to order dated 24.11.2014, a status report on behalf of Department of Law, Justice and Parliamentary Affairs, has been filed in which it has been given out that the Planning and Development Department vide letter dated 19.11.2014 has intimated that balance funds were to be released only after these are cleared by the Planning Commission of India/Union Finance Ministry. In that regard, a communication has been addressed by the Planning and Development Department to the Secretary to Government, Law, Justice and Parliamentary Affairs Department. The bench observed that it is undisputed that budgetary allocation for the construction of court complexes and chambers for lawyers has already been made. However, we fail to understand why the funds were to be released only after clearance from the Planning Commission of India or the Union Finance Ministry. To seek clarification, the bench directed that the Director (Coordination), Planning and Development Department shall remain present in person to explain as to how the Planning Commission or Union Finance Ministry has come in picture for release of funds for the construction of lawyers' chambers.
