HC stays proceedings in corruption case against CE, Foreigner & Ors 2/4/2015 11:36:30 PM Jammu, Feb 4: In a much publicized trap case in which Chief Engineer Mechanical Engineering Dept Jammu, AEE Mechanical Engineering Dept Jammu, one foreigner MD M/s CAS India Pvt Ltd Gurgaon, DGM M/S CAS India Pvt Ltd were allegedly involved, J&K High Court Jammu Wing issued notice returnable within three weeks respondent and ordered proceedings before the Trial Court shall remain stayed. Foreigner namely Hanho Yoon alias Calvin Yoon of South Korea MD M/S CAS India Pvt Ltd Gurgaon, Anil Dhar DGM M/S CAS India Pvt Ltd field petition in the State High Court against the order of the trial court for framing charges,. Justice Bansi Lal Bhat of J&K High Court Jammu Wing after hearing Sr Adv Sunil Sethi with Adv Ravi Abrol appearing for the petitioner observed that it is contended that despite the trial court coming to the conclusion that no illegality was committed by the accused Zahoor Hussain Zargar Chief Engineer while awarding contract to M/s CAS Weighing India Private Limited. It also observed that the trial Court proceeded to frame charges against the petitioners for offence u/s 5(1) d r/w section 5(2) Prevention of Corruption Act amd 161, 165-1 and 12-B RPC and it is contended that there was no material on record even to suggest that supply order was withheld with criminal intention of deriving any undue pecuniary benefit, issued notice returnable within three weeks and meanwhile proceedings before the Trial Court shall remain stayed.
