HC direction against illegal construction of Panchayat Ghar flouted 2/10/2015 9:37:52 PM Early Times Report Kathua, Feb 10: Residents of village Dhammal ,CD block Barnoti, Tehsil Marheen Distt. Kathua has demanded implementation of order dated 02.02.2015 passed by High Court of J&K in OWP no. 26/2015, CMA no. 106/2015 which restrains the construction of an illegal structure on a government land. Learned counsel for the villagers stated that the Field Revenue Staff has conducted the demarcation and the concerned Patwari on 19th of Aug 2014 submitted a report stating therein that as per spot inspection/ demarcation and revenue record, the land comprising Khasra no.534 measuring 3 Kanals and 15 marlas situated at village Dhammal Tehsil Marheen is in the nature of Shamlat Ghair Mumkin Talab- Muffedey Aam, out of which land measuring 18 marlas was being used for illegal construction of new Panchayat Ghar. The Naib-Tehsildar concerned has also passed an order for restraining illegal construction in Khasra no. 534 and also directed SHO, Police Station, Rajbagh in this regard to stop the illegal construction three months ago. It is pertinent to mention here that the concerned Sarpanch of Panchayat Halqa Dhammal and the persons employed by him raising illegal construction of Panchayat Ghar at Morha Mangtian be restrained to raise any construction in the land comprising of Khasra no. 534 which is in the nature of Gair Mumkin Talab Mufeeday aam in the interest of Justice as the matter involved urgent and emergent nature. Earlier, the Deputy Commissioner Kathua has passed an order no. DCK/Legal/2014-15/ 748-55 dated 22.1.2015 for construction of the Panchayat in village Dhammal CD Block Barnoti which was later on stayed by the court. Police Official, Rajbagh said that the action was taken against illegal construction before appeal filed in court. He informed that meanwhile after inquiry DDC Kathua ordered for construction of the Panchayat Ghar. He added that at present the court directed revenue department to stop the construction work of Panchayat Ghar and Revenue department has to take action. He ensured, 'if the direction passes to Police department, department will take action thereafter."
